Client is responsible for haul out appointment and fee.
This survey checks for compliance with
U.S. Coast Guard regulations, ABYC, NFPA standards and practices, and
general structural condition. It
does not cover defects which could not readily be discovered by inspection
without removal of machinery, tanks, sheathing, joinerwork, upholstery,
bulkheads, ceiling, fascia, or other fixed material or any area requiring
disassembly to obtain access. Electronics
will be checked for power up condition but operational functions will not
be tested. External systems
connected to the engine will be examined but the internal condition of the
engine will require a mechanical survey by a qualified mechanic and will
not be a part of this survey. On
a sailboat the surveyor will not go up the mast.
A through inspection of the boat will be conducted but due to
access and time restrictions, an absolutely 100% complete inspection is
not possible. Our surveyor
will exercise due care but we can never guarantee that we will find every
defect.
Roger Bass and Associates, Inc.,
A Florida Corporation, hereafter referred to as Corporation, agrees to
furnish a professional report of survey for the sum of $
.00. Payment to be
made in US dollars the day of the survey.
Reports are prepared within five working days.
This agreement is subject to acceptance within 20 days and is void
thereafter at the option of the undersigned.
The undersigned will conduct this survey
and issue a report for the sole use of the specified requesting party for
an agreed fee based upon the intended use of the report and the legal
liability of the undersigned; accordingly, others are not to use this
report and not rely upon the contents of this report without payment to
the undersigned of an additional agreed fee based upon reevaluation of the
same factors; further, the undersigned shall have no liability for
property loss damages, and no liability for punitive damages, all of which
shall be deemed to have knowingly and voluntarily waived upon use of this
report; further, in no event shall the legal liability for the undersigned
ever exceed the fee paid by the requesting party for issuance of this
report, regardless of the number of claims or suits and regardless of
whether under theory of tort, contract, warranty, products, outrage, or
otherwise.
The survey contains opinions and
observations based on my skill, experience and training as a marine
surveyor and consultant. Under
no circumstances shall the report be understood to constitute a
representation, guarantee, or warranty, expressed or implied, of any kind
as to the condition or soundness of the subject vessel, its hull, engines,
machinery equipment or systems or any part of appurtenances thereof, or
the cost of effecting any repairs or modifications.
The report of survey is not valid until the fee for the survey fee
is paid in full.
Attorney fees; costs: In any litigation
arising out of this contract, the prevailing party shall be entitled to
recover reasonable attorney’s fees and costs.
